Don’t be an unprepared owner!

Mr. Dubois, an owner of a beautiful chalet – second home – in Anzère

Mr. Dubois recently realized that construction work on several chalets was being carried out near his second home. Unfortunately, Mr. Dubois was only informed of these projects once the public inspection was closed and the work was already well advanced. As a result, he missed the opportunity to consult the construction project file and to object to the building permit application in time, which would have enabled him to assert his rights and interests as a landowner. He feels wronged and is strongly dissatisfied with the impact these works have on his second home, particularly in terms of view. He has therefore decided to express his dissatisfaction and disapproval to the commune and the companies responsible for the construction.

Unfortunately, he is now unable to do anything to mitigate the impacts of these constructions on his property. He deeply regrets not having been informed in time and not having been able to act to protect his rights, interests, and property. Hoping that this situation will not be repeated in the future, he subscribes to one of our subscriptions to be kept informed of any construction projects in the vicinity of his second home and thus be able to act accordingly at the appropriate time...

Mr. Nanchen, a 59 years old owner of an undeveloped land parcel located in the commune of Nendaz

Mr. Nanchen was confronted with a surprise when he learned, from a better-informed neighbour, that the modification of the communal Land Use Plan (LUP) directly impacted the use of his land parcel. Indeed, this land use measure has profoundly changed its possibilities. Now in a deferred use zone (zone d’affectation différée), he can no longer build his future main residence for his upcoming retirement, in which he hoped to spend happy days. Although temporarily limited in time, this measure harms the value and the possibilities of use of the land parcel and Mr. Nanchen’s project.

Mr. Nanchen profoundly regrets not being aware of this land use measure in time and not having subscribed to our subscription, which would have allowed him to follow regulatory developments and protect his rights, interests and property to the best of his ability. He could have consulted the files, participated in the procedures and even opposed certain planning measures. The modification of the LUP having come into force, he can’t do anything unfortunately and must accept the consequences of this modification, relinquishing the construction of his future main residence for his impending retirement...
