Privacy Statement
1. General
This privacy statement applies to the monbienfonds.ch website, from now on referred to as the Site, operated by the company GSC Géo Services & Conseils Sàrl, Rue de la Dent-Blanche 4, 1950 Sion, Suisse, from now on referred to as GSC.
The management and processing of personal data by GSC are essentially governed by the Federal Act on Data Protection (FADP, RS 235.1) and the Ordinance to the Federal Act on Data Protection (DPO, RS 235.11) of Switzerland.
GSC promotes the transparent processing of personal data and attaches particular importance to their protection. It undertakes to respect the general principles of good faith, proportionality, recognizability, finality, and accuracy, aiming to collect and process only the data necessary to provide its services.
If any contradiction between the provisions of this privacy statement and the other contractual conditions or the general terms and conditions of sale of GSC applicable in the rest, the provisions of this privacy statement shall take precedence.
2. Definitions
User: person navigating the Site;
Member: user who has created an account on the Site;
Subscriber: member with a valid paid subscription on the Site;
IP address: A temporary or permanent unique identifier assigned to a computer (or other devices) connected to the Internet;
Personal data: “all information relating to an identified or identifiable person” (Federal Act on Data Protection, RS 235.1)
3. Acceptance
By navigating the Site, the User declares that they have read, understood, and accepted these provisions.

5. Site hosting
The Site is hosted in Germany.
Backups of the Site are stored in encrypted form in the Netherlands.
6. Recorded data
GSC collects, processes, and store data (personal) when using the Site, registering, subscribing, or subscribing to newsletter, to provide quality services to users and subscribers.

7. Credit card payment data
During the credit card payment transaction through the Stripe provider, GSC does not have access to the User’s confidential information or the credit card number.
8. Web analysis tools
GSC uses the free Matomo software to collect audience analysis data to optimize the functioning and improve the Site’s services. This data is kept on GSC servers and is mainly used for internal statistical purposes.
GSC uses New Relic, a third-party website monitoring and performance analysis service, to collect anonymous navigational data such as user interactions with the Site, page response times and errors encountered. This data is collected for the purpose of improving performance and user experience. By using the Site, the User consents to the collection and processing of such data by New Relic in accordance with their privacy policy.
9. Recording and retention of log files
To ensure the proper functioning of the services, preserve security and detect any problems or malfunctions, the Site records various data, such as the IP address, date and time of access, and the pages or services consulted, in log files. These data are used to provide high-quality services and to improve GSC’s services. The log files are kept for a variant duration of 7 days to one year before being deleted. Security log files can be kept indefinitely.
10. Use of cookies
GSC only uses utility cookies, such as session cookies and XRSF cookies, to ensure the proper functioning of the Site. These cookies are only used for practical purposes and do not contain the User’s personal information. They are used to maintain the User’s connection to the Site and to ensure the security and confidentiality of the data transmitted. These cookies are automatically deleted when the User leaves the Site or closes their browser.
11. Satisfaction survey
GSC may conduct satisfaction surveys with its subscribers to continuously improve the quality of its services. These surveys are optional, and subscribers can refuse to participate.
The data collected during these surveys is treated confidentially and will not be used for commercial or advertising purposes. They are only intended for GSC’s internal analysis and will not be shared with third parties.
12. Data recording and storage
GSC stores all the Site’s data in data centres located in Switzerland and Germany.
The Subscriber’s data is kept for the duration of the validity of his account.
13. Data security
To protect the collected data from unauthorized use, modification, loss, or disclosure, GSC implements strict technical and organizational measures. These measures include, in particular, encrypting data between the Site and the User’s browser using SSL (HTTPS), periodic backups, and rigorous access through authentication and or two-factor authentication.
It should be noted that the transmission or sending of information via the Internet or by email carries a particular security risk for this information, including, for example, the interception of data by unauthorized third parties, the manipulation or simulation of the sender’s identity in emails, and the transmission of viruses or malicious software.
Although GSC implements technical and organizational measures to protect data against unauthorized use, modification, loss, or disclosure, it cannot guarantee this data’s absolute security and confidentiality.
GSC shall not be held responsible for direct or indirect damage caused to the User or to third parties as a result of the theft of data or the hacking of the infrastructure and/or servers of GSC and the Site.
14. Confidentiality
GSC undertakes to respect the confidentiality of data under applicable laws and regulations on the protection of personal data and will take all necessary precautions to protect the User’s data and ensure its security and confidentiality.
15. Transmission of data to partners
GSC undertakes to transmit its subscribers’ data to external partners only to provide additional services requested by the User and only with the latter’s prior agreement.
16. Use of data for advertising purposes
No use is made of the User’s data for advertising purposes.
17. Data deletion
In the event of the deletion of an account by its member, GSC undertakes to delete and or anonymize the latter’s data within thirty days of the deletion request. However, for accounting purposes, some data related to placed orders may anonymized.
The deletion of a member’s data, inducing the deletion of their account and, if applicable, the termination of their subscription, can be requested at any time using the contact form available on the Site or by email.
18. Rights
The User can request an excerpt of the data concerning them, their rectification, correction, or deletion using the contact form available on the Site or by sending a request by email.
GSC handles any request carefully and efficiently under the applicable laws and regulations on data protection.
19. Obligations of members and subscribers
Members and subscribers must to update their data to ensure its quality and accuracy.
GSC strongly recommends that members enable two-factor authentication on the site to enhance the security of their accounts.
20. File holder for collected data
GSC is the file holder for the collected data.
21. Modification of the privacy statement
GSC reserves the right to modify, update, or supplement this privacy statement at any time and without notice.
Site users are encouraged to consult this statement regularly to note of any possible changes.
Any further use of the Site or its services by the User will be considered as acceptance of these modifications.
22. Saving clause
If any provision of this Privacy Statement is invalid or unenforceable, this shall not affect the validity of the remaining provisions. The latter shall remain in force and shall be applied correctly.
In such a case, the invalid provision shall be replaced as far as possible by a provision that best fulfils the purpose of the invalid provision.
Consequently, the parties expressly agree that the nullity or invalidity of one of the provisions of this Privacy Statement shall not affect the validity of the other provisions, nor shall it affect the performance of the Privacy Statement as a whole.

In case of contradiction with any other translated version, the French version of these definitions shall prevail.
24. Applicable law and place of jurisdiction
This privacy statement is governed by Swiss law. In case of a dispute, the competent jurisdiction is Sion, Switzerland.
